About the book:

In this book, Dr. Aviv Gaon offers an extensive analysis of intellectual property and authorship theories and explores the possible impact artificial intelligence (AI) might have on those theories. The author makes compelling arguments via the exploration of authorship, ownership, and AI.
The book advocates for a more holistic approach to authorship, arguing that there is no good reason to exclude computer-generated and AI creations from copyright. In addition, it conducts an open search for the right ‘candidate’ for ownership. In doing so, the book explores several possible legal frameworks, including assigning ownership to the programmer, the user, the AI itself and other alternatives such as the public domain or author-in-law approaches. Finally, the book explores the concept of AI as it has developed through the years in various fields, seeking to reframe the AI legal concept.

About the Speakers:

Professor Peter Menell’s research and teaching span intellectual property across the digital technology and entertainment fields, as well as environmental law and policy, property law, and law and economics. His current teaching focuses on intellectual property law, legal protection for digital technology, technological disruption and social justice, and intellectual property protection in the entertainment industries. Professor Menell founded the Annual Review of Law and Technology, published by the Berkeley Technology Law Journal, in 1997.  Professor Menell has authored more than 100 articles and 15 books, including leading casebooks, intellectual property treatises, and research handbooks. Professor Menell served as Vice-Chair of the National Academies of Sciences project on copyright and innovation. In 2013, he delivered the 42nd Brace Lecture, the U.S. Copyright Society’s major annual lecture. In 2012-13, he served as an inaugural Thomas Alva Edison Visiting Professional at the U.S. Patent & Trademark Office. In 2018, the California Lawyers Association recognized Professor Menell’s contributions to the intellectual property field with its IP Vanguard Award.

Professor Pina D'Agostino is a law professor, lawyer, public speaker, board director and recognized international scholar at Osgoode Hall Law School, York University specializing in intellectual property (IP), technology and innovation law and policy. Professor D’Agostino has testified before Parliament and is a widely published author, regularly serves as a consultant and is a cited authority at the Supreme Court of Canada and in various media. She serves as the Editor-in-Chief of the Intellectual Property Journal. Professor D’Agostino brings her creativity and passion to trailblaze new initiatives and to serve in new roles as Founder and Director of the globally-recognized IP Osgoode, the award-winning, IPilogue, the IP Intensive, the IP Innovation Clinic, the first legal clinic of its kind helping inventors and start-ups across Canada and, more recently, founded the AI-powered IP Innovation ChatBot allowing underrepresented groups and the general public greater access to IP information. Professor D’Agostino is Co-Chair of the York University AI & Society Task Force, is appointed to the City of Vaughan Smart City Task Force and is a Senior Fellow at the Centre for International Governance Innovation (CIGI).

Professor Stavroula Karapapa is a professor of Intellectual Property and Information Law at the University of Essex, School of Law. Karapapa writes and teaches about the challenges that digital technologies pose for existing legal regimes, particularly intellectual property law and digital rights. She is interested in the legal regulation of digital networked environments, digital humanities research, big data, and artificial intelligence (in particular machine learning) and has focused much of her career on how the law has sought to regulate and otherwise shape information technology—as well as the impact of information technology on the law. Her work is distinctive in its socio-legal and comparative outlook and often involves doctrinal analysis at the interface of other disciplines. Her work has been cited in UK Intellectual Property Office draft legislation, Opinions of the Advocate General, and official reports of the European Commission, the Canadian Privacy Commissioner, and the US Copyright Office. She offers expert opinion to the UK Intellectual Property Office and the European Commission on issues related to copyright law reform since 2012.

Dr. Aviv Gaon is a faculty member at the Harry Radzyner Law School, Reichman University (IDC Herzliya). He holds a Ph.D. from Osgoode Hall Law School, York University, and LL.B (Cum Laude) and LL.M from Reichman University. His work in the area of intellectual property and technology earned him the IP Osgoode David Vaver Medal for Excellence in IP Law in 2019. In 2019-2020, Dr. Gaon was a Post-Doc Fellow at the Munk School of Global Affairs and Public Policy at the University of Toronto. Dr. Gaon is a research fellow at IP Osgoode Center for Intellectual Property and Technology at Osgoode Hall Law School, and in 2019 he joined the Intellectual Property Journal (IPJ) editorial board – a leading Canadian journal for intellectual property and technology research. Dr. Gaon’s scholarship focuses on Intellectual Property, Law & Technology and Competition Law. His publications address the legal implications of emerging technologies, intellectual property, and artificial intelligence.
