Module description

This is an introductory module to the LLM International Trade and Maritime Law and represents a key segment of international commercial law. It focuses on two main parts.

1. Introduction to the components of International Trade and Maritime Law, how it fits into international commercial law and the key international organisations and legal instruments in the international trade and maritime sector;

2. Some latest developments in Shipping such as Digitalisation, Trade and the Environment, Autonomous Vessels and Multimodal Transport.

Module aims

The primary aims of this module are:

1. to familiarise students with the techniques of dealing with common law and international conventions;
2. to consider the latest developments concerning shipping industry and shipping law;
3. to equip students with the abilities to identify the challenges brought by the new technologies and political changes to shipping law and to seek solutions; and
4. to practise students’ critical analysis and research skills.

Module learning outcomes

1. To interpret relevant legal materials including international conventions and regulatory policies;
2. To explain and apply legal principles relating to the field with support of primary sources;
3. To appraise and evaluate areas of debate in the field;
4. To develop competent research skills so that students can describe and justify legal reasoning with the support of cases and scholarly work.
5. To work with others on a group project on a topic within the area of the module.

Module information

1. Introduction to International Trade and Maritime Law

Introduction to the basics of English legal system, the position of trade and maritime law in it, basics of ships, different aspects of international trade and maritime law and the key international organisations and legal instruments in international trade and maritime sector.

2. Digitalisation of Trade Finance

Digitalisation is occurring across many different areas in law but here we focus on trade finance aspects and closely linked to this electronic shipping documents. This is particularly relevant as the Law Commission in the UK is currently working on an Electronic Transport Documents project and, it seems, the elusive electronic bill of lading may finally become a reality.

3. Autonomous Vessels

Looking at the development and different types of autonomous vessels as well as the various techniques used; identifying the challenges brought about by autonomous vessels to shipping law; evaluating to what extent the current national and international regulatory frameworks apply to the autonomous vessels; considering whether new regulatory framework is necessary to embrace autonomous vessels.

4. Multimodal Transport

Looking at how multimodal transport is operated and its advantages over unimodal transports (sea, road, rail and air); identifying the challenges caused by multimodal transport to shipping law; examining the extent to which the current international conventions on unimodal transports apply to multimodal transport; evaluating the efficacy of different attempts in unifying multimodal transport at the international level; considering how multimodal transport could be properly and effectively regulated.

5. Shipping and the Environment

The IMO has set very ambitious targets for the shipping sector in its GHG 2023 strategy. The industry is adjusting to several new limits as to SOX and NOX but there are many in the surrounding industries that say the shipping sector is not doing enough. We look at the current regulation requirements and try to predict what the future holds.

Learning and teaching methods

The module is delivered by 9 two-hourly interactive lectures/seminars. PowerPoint slides and the associated reading list and activities for each week's topic will be uploaded to Moodle in advance. You will be able to find these documents in the grid for each week. In general, you're expected to familiarize yourself with the lecture slides, complete the reading for each week in advance, and prepare answers to the activities and questions set. There is no single LLM level textbook covering the entire course and since the module is dedicated to current issues in shipping, students are expected to keep up to date with shipping news from sources such as Hellenic Shipping News and World Maritime News.
