Your Tier 4 application outcome – refused or rejected

This information and guidance is for students who are studying or applying to study at the University of Essex and have made a Tier 4 application to the Home Office using a CAS (Confirmation of Acceptance for Studies) issued by us.

If your application has been refused or rejected as invalid, see the relevant section below and seek immigration advice from our International Services Team immediately. The Home Office decision will be checked and you will be advised what options are available to you and how this may affect your planned studies.

As a Tier 4 sponsor the University must adhere to the Home Office requirements and it is possible that you will not be able to continue or start your studies as planned.

It is very important that you seek advice as soon as you receive the outcome.

    What should I do now?

    If your application has been returned to you as invalid or refused and you are;

    • Continuing the same course: your refusal/rejection must be checked by our International Services Team and advice given before the University will consider a request for a new CAS, if one is necessary. Email a scanned copy of the outcome of your application to intadv@essex.ac.uk.
    • New course: send Admissions a scanned copy of the outcome of your application by emailing visaquery@essex.ac.uk. If your application has been refused and you believe it to be incorrect please seek immigration advice immediately from our International Services Team by emailing a scanned copy of the refusal to intadv@essex.ac.uk. Students who have been refused on grounds other than maintenance (funds) must have the refusal checked and receive immigration advice from the International Services Team before the University will consider a request for a new CAS. Students who have been refused on maintenance (funds) grounds must be able to show they meet the Tier 4 requirements before the University will consider a request for a new CAS.

    After you have received immigration advice you can choose what action to take.

    Administrative Review

    Refused: If you made your application 'in time', that is before your last visa expired and it has been refused, you should be given the right to request an Administrative Review and must do this by the Home Office deadline. Read the UKCISA guidance for more information and seek immigration advice immediately.

    If your application is refused but your last visa is still valid when you receive the decision you must make another Tier 4 application before your current visa expires. You will need a new CAS and up to date documents and should seek immigration advice before making a new application.

    Rejected as invalid: If your application has been rejected as invalid you will not have a right to Administrative Review but may be able to make another application, you will not need a new CAS but must seek immigration advice from our International Services Team before you do anything.

    Before taking any further action: seek immigration advice from our International Services Team or an immigration lawyer.

    What should I do now?

    If your application has been refused;

    New course: send Admissions a scanned copy of the outcome of your application by emailing visaquery@essex.ac.uk.

    Students who have been refused on grounds other than maintenance (funds) must have the refusal checked and receive immigration advice from our International Services Team before the University will consider a request for a new CAS. Students who have been refused on maintenance grounds must be able to meet the Tier 4 requirements before the University will consider a request for a new CAS. If you believe your refusal is incorrect we recommend you request an Administrative Review (see below) and seek immigration advice immediately.

    Continuing the same course: your refusal must be checked by our International Services Team and advice given before the University will consider a request for a new CAS.

    Administrative Review

    The Home Office will give you the option to request an Administrative Review if your entry clearance application is refused. There is a deadline to request this review. An Administrative Review will be carried out within 28 days, the original application and documents will be reviewed and no new documents can usually be submitted. Read the UKCISA guidance for further information.

    If you believe the refusal was incorrect, the only way to overturn this decision is via Administrative Review. If you do not request an Administrative Review, or it is withdrawn, or the outcome of the review is that the original decision is upheld, the refusal will remain on your immigration history and must be declared in future applications. If you submit an Administrative Review and afterward make a new immigration application, the Administrative Review will be automatically withdrawn by the Home Office.

    If you would like to make a further application overseas you will need to request a new CAS. If the reason for your refusal is on credibility grounds, the University may not be able to issue you with a new CAS.

  • How do I request a new CAS?

    If your application has been rejected as invalid and you are submitting an Administrative Review you will not need a new CAS.

    If you have been advised by the University to make a new Tier 4 application you will need to request a new CAS.

    Depending on the circumstances the University may not be able to issue you with a CAS.

  • New and future immigration applications

    It is important that you give the details of any refusal in the relevant section of all future immigration application forms you complete, even if you have had the decision overturned by Administrative Review or Right of Appeal.

    If you have ever overstayed and/or breached any of the conditions of your immigration permission you must disclose this on all future applications. Failure to disclose could lead to a lengthy ban under the Immigration Rules, Part 9 - General grounds for the refusal of entry clearance, leave to enter or variation of leave to enter or remain in the United Kingdom.

    Before making a new Tier 4 application from within the UK or overseas please read all relevant guidance to ensure you meet all the Home Office requirements and can provide all the specified documents. If you have any doubts please seek advice.

    If you intend to make a new application overseas, check how long it is likely to take for your application to be processed by using the Home Office guide to visa processing times. You must be able to arrive at the University by the latest accept date recorded on your CAS.

    How to request immigration advice

    Please email us with details of your case and attach a copy of your outcome letter intadv@essex.ac.uk. We will email you back and may make you an appointment if you are in the UK.

    In some circumstances the University will not be able to decide if we are able to sponsor you under Tier 4 until you have sought advice from the International Services Team.
