Online Learning and SENDA

What is SENDA?

The Special Educational Needs and Disability Act 2001 (SENDA) amends the Disability Discrimination Act (DDA) 1995. The Act came into force in September 2002, and makes it unlawful to discriminate against students with a disability. Whereas previous provision was essentially reactive to needs, current legislation places an anticipatory duty on the University.

In essence, SENDA 2001 requires HE staff to be proactive and to consider what 'reasonable adjustments' should be made to existing courses, as well as to courses in development. Governing Bodies of institutions could be held legally liable for any failures to abide by the Act, and individuals could also face litigation.
