Summary content
Lack of knowledge amongst employers regarding the law governing Health & Safety in the Workplace may
lead to liability - both civil and criminal, for breach. The 'blame and claim' culture has created
an expectation in individuals that they are somehow entitled to compensation, which means that
businesses increasingly have to assess and manage risk as part of corporate strategy. This half-day
practical session will cover important issues employers should be familiar with, in order to
discharge their duty to take reasonable care for the safety of their employees. Certificates of
attendance will be given to all delegates.
Objectives
- To gain an understanding of the common law duty imposed on the employer to ensure the safety of his employees i.e. provide competent fellow employees, a
safe plant and equipment, a safe place and a safe system of work.
- To be aware of the potential for vicarious liability of the employer for the actions of his employees.
- To appreciate the importance of complying with the Health and Safety at Work Act 1974.
- To comprehend the new statutory indictable offence under the Corporate Manslaughter and Corporate Homicide Act 2007, whereby companies can be made
criminally liable for causing a person's death, due to a gross breach of a relevant duty of care by its management.
