Terms and Conditions of Business
The University of Essex Careers Centre only accepts instructions from
Registered Companies and Organisations on the following terms and
conditions:
"the University" means the University of Essex.
"the Careers Centre" means the University of Essex Careers Centre.
"the Client" means the company or organisation hiring an individual
introduced by the Careers Centre.
1) The hire of an individual introduced by the Careers Centre shall be
deemed acceptance of and agreement to these Terms and Conditions of
Business.
2) The Client will inform the Careers Centre of every University of Essex
student it employs via our online
feedback form.
3) The Client shall pay the hourly rate agreed with the individual
directly to the individual and is responsible for National Insurance and P.A.Y.E. contributions if applicable.
4) The Client undertakes to provide the individual with suitable
supervision in order to ensure the client’s satisfaction with the
standards of workmanship provided by the individual but notwithstanding
this should the services provided by the temporary worker prove
unsatisfactory his/her service may be terminated immediately by the
Client.
5) Individuals provided through the Careers Centre are deemed to be under
the direct control of the Client from the time that they first report for
work and throughout its duration. The Client agrees to be responsible
throughout this period for all acts, errors or omissions be they wilful
negligent or otherwise as the individual is on the payroll of the Client
and the Client will in all respects comply with all statutes, bye-laws and
legal requirements to which the Client is ordinarily subject in respect of
its staff. The Client will indemnify the Careers Centre against any claim,
action, proceeding or allegation in respect of any loss or damage suffered
or caused by any individual engaged through the Careers Centre.
6) The Careers Centre endeavours to ensure the suitability of all
individuals it places with clients. The Careers Centre will not be held
responsible for misrepresentation by applicants whether orally or in
writing of their history, character, age or capabilities.
7) The Careers Centre and the University shall bear no liability for loss,
damage or delay howsoever arising caused in circumstances outside its
control (of whatsoever kind).
8) If at any time any question, dispute or difference whatsoever shall
arise between the Careers Centre and the Client in relation to or in
connection with the Contract, either of them shall give to the other
notice in writing that it requires such question, dispute or difference to
be referred to the arbitration of a person to be agreed upon by them or
failing agreement within 14 days after the date of such notice of some
person to be appointed on the application of either party by the president
for the time being of the Suffolk and North Essex Law Society pursuant to
the Arbitration Acts 1950-1979.
9) If any provision of these Conditions is held by any court or competent
authority as invalid or unenforceable in whole or in part the validity of
the remainder of these Conditions and of the remainder of the provisions
in question shall not be affected.
10) The Client shall not assign or transfer any contract to which these
Conditions apply nor the benefit thereof to any person whatsoever.
11) The Construction, validity and performance of any contract shall be
governed in all respects by the law of England and the Client shall at all
times provide the Careers Centre with an address in England or Wales where
it will accept service of proceedings.
12) Any notice required to be given under these Conditions may be sent by
letter or facsimile to the principal place of business or registered
office of the party to whom the notice is being sent.
13) By submitting a vacancy online you agree to the terms and conditions
detailed above.
