Final Green Light for Establishment of African Human Rights Court

Interights - The International Centre for the Legal Protection of Human Rights

April 2006

Almost two years after the entry into force of the Protocol to the African Charter on Human and Peoples' Rights on the establishment of an African Court on Human and Peoples' Rights, the Assembly of the African Union gave a green light for the establishment of the Court. It will be based in East Africa in a country chosen by East African countries, and Judges were elected in January 2006 at the 6th Ordinary Session of the Assembly. The Registrar and the staff will be nominated by the Commission of the African Union, which will also determine the budget allocated to the new body. The relationship between the African Commission, the Committee of Experts on the Rights and Welfare of the Child and the new human rights Court will be discussed when the Court is effectively established.
